Will They or Won’t They?

No, we’re not talking about the ongoing love triangle on our favorite political thriller, Scandal. We’re referring to the hottest debate to hit the Supreme Court since the PPACA challenge in 2012. The Supreme Court met ton October 31, 2014 to determine whether they will include a challenge to the health reform law relative to subsidy distribution in federal exchange states, known as the King v. Burwell case, on their 2015 docket.

The King case is one of four major challenges to the health law’s subsidy and employer mandate requirements that is currently making its way through the federal court system. In this particular case, judges in the Fourth Circuit of the US Court of Appeals ruled 3-0 in July that, based on legislative intent, federal subsidies should be available to individuals in both federal and state-based marketplaces. Plaintiffs in the case immediately appealed to the Supreme Court, which resulted in the October 31st meeting.
